Litigation Services at Tatman Legal
Litigation for Lenders, Servicers and Investors
When a default file turns into a lawsuit, the same team stays on it. We defend wrongful foreclosure, TILA and Rosenthal Act claims, prosecute deficiency and guaranty actions, quiet title and reform recording errors, resolve lien priority and surplus fund disputes, and sue tow yards and repair shops that sell financed collateral in violation of the lien statutes. The firm holds HUD approval and FNMA approval in California and appears in state and federal courts in Arizona, California, Florida, Oregon, Texas and Washington.
Deficiency and Guaranty Actions
After a trustee’s sale, a replevin recovery or a short sale, we pursue the balance the collateral did not cover where state law allows it, including suits against guarantors and on carve-out provisions.
Wrongful Foreclosure Defense
We defend lenders, servicers and trustees against wrongful foreclosure, dual-tracking, Homeowner Bill of Rights, TILA, RESPA and Rosenthal Act claims, and against temporary restraining orders filed to stop a sale.
Title Curative and Quiet Title
Erroneous reconveyances, broken assignment chains, missing legal descriptions and competing deeds are cured through quiet title, reformation and declaratory relief so the lien can be enforced.
Surplus and Excess Proceeds Claims
We file and defend claims to surplus funds after a senior sale on behalf of junior lienholders and credit unions.
Lien Priority Disputes
We litigate priority between deeds of trust, HOA assessment liens, tax liens and judgment liens, including equitable subrogation claims.
Conversion Claims Against Tow Yards and Repair Shops
When a yard sells or strips a financed vehicle in violation of the lien sale statutes, we sue for conversion and the statutory penalties on behalf of the lienholder. See our replevin and impound recovery page.
