Bankruptcy Representation for Secured Creditors, Credit Unions and Mortgage Servicers

Tatman Legal represents the creditor, never the debtor, in bankruptcy courts across Arizona, California, Florida, Oregon, Texas and Washington. Darren J. Devlin leads the bankruptcy practice. We protect the collateral and the claim: relief from the automatic stay under 11 U.S.C. 362(d), proofs of claim under Rule 3001, objections to Chapter 13 plans under sections 1322 and 1325, and Rule 3002.1 payment-change and final-cure compliance for mortgage servicers.

Questions Creditors Ask

How fast can you file a motion for relief?

Within 2 business days of receiving the note, the security instrument, the payment history and the post-petition default figures.

What happens if the debtor files repeatedly?

We seek in rem relief under 362(d)(4) so the order binds the property for two years regardless of later filings.

Do you handle reaffirmation for auto loans?

Yes, including negotiating the terms and appearing at the reaffirmation hearing where the court requires it.

Do you represent debtors?

No. The firm represents creditors only.
