Jason C. Tatman holds HUD designation as a Single Family Foreclosure Commissioner and conducts non-judicial sales of HUD-held mortgages under the Single Family Mortgage Foreclosure Act, 12 U.S.C. 3751 to 3768, and 24 C.F.R. Part 27, Subpart B. The firm serves as commissioner in Arizona, California, Hawaii, Nevada, Oklahoma, Oregon, Texas and Washington for HUD, its servicing contractors, and HECM reverse mortgage servicers whose loans have been assigned to the Secretary.
What a Commissioner Sale Is
Once HUD holds a mortgage, the Act preempts state foreclosure procedure and the designated commissioner conducts the sale. The commissioner serves and publishes the Notice of Default and Foreclosure Sale with the elements required by 12 U.S.C. 3757, publishes once a week for three consecutive weeks, mails the notice to the mortgagor and lienholders at least 21 days before the sale, conducts the public auction, and delivers the commissioner’s deed. There is no post-sale right of redemption.
HECM Reverse Mortgage Foreclosures
Reverse mortgages assigned to HUD after the loan reaches 98 percent of the maximum claim amount are foreclosed through the commissioner once the loan is due and payable, whether by the death of the last borrower, non-occupancy, or unpaid taxes and insurance. We coordinate with the servicing contractor on the due and payable approval, the appraisal, and the occupied conveyance process after sale. Deed in lieu and short sale options are handled through our loss mitigation team.

The notice period alone is roughly five weeks from first publication. Most files close within 90 days of referral when the file arrives complete.
Does state foreclosure law apply?
No. The Act governs the notice, the sale and the deed. State law still governs post-sale possession and recording.

What do you need to open a file?
